§ 111.363. Registration of credentials for peddlers—Application fee.

  • A.

    Whoever desires to engage in peddling as defined in Section 111.360(A) shall register his credentials and shall submit in duplicate with the License and Assessments Clerk a written application on a form to be provided by the License and Assessments Clerk, along with a valid driver's license or identification card issued by the State of Ohio or any other state for inspection and copying, correctly setting forth the following information:

    1.

    The full name, address, and social security number of the applicant;

    2.

    Whether or not he or she uses any motor vehicle(s) in his or her business, and if so, the make(s), model(s), year(s) and current registration number(s) thereof;

    3.

    The name, address and phone number of his or her business or employer, and a contact person therein;

    4.

    A brief description of the goods, wares, merchandise or services involved; and

    5.

    Whether or not he or she has ever been convicted of any crime, other than a traffic offense, and if so, the nature thereof and the penalty therefor.

    B.

    Concurrently with the filing of the application, the applicant shall pay a fee of thirty-five dollars to the License and Assessments Clerk to compensate for the costs incident to the examination, registration and issuance of stamped copies of credentials.

    C.

    Registration shall be approved within five business days after receipt of the completed application unless:

    1.

    The applicant has provided false information in his or her application; and/or

    2.

    The applicant named on the application has been convicted of a felony violation or misdemeanor violation as set forth in Subsection (G) of this section within the past five years.

    Such registration shall be stamped with the date of expiration which in each case shall be the close of the current calendar year or six months, whichever is later.

    D.

    Once issued, registration may be used only in conformity with the laws of the City and the State of Ohio; may not be assigned or transferred; must be carried by the peddler at all times; and may be revoked for any of the following causes:

    1.

    The peddler named in the application or person preparing the application on behalf of the peddler provided false information in the application; and/or

    2.

    The peddler is convicted of a felony or misdemeanor as set forth in Subsection (G).

    E.

    Possession of registration credentials shall not entitle the applicant to enter upon any lot or land specified in Section 111.364 between the hours of sunset and 9:00 a.m. nor shall such credentials be valid for the peddling of any goods or services not disclosed in the original application.

    F.

    Any person who has not reached eighteen years of age shall be required to have a parent, guardian or employer co-sign on the application.

    G.

    Any person who has been convicted of or who has plead guilty to any criminal offense of the Ohio Revised Code, United States Code, or any other substantially similar state or local code provisions that constitute any theft or fraud offense, any offense of burglary, any offenses of violence, or any offenses of any sex crime law or statute within the last five years is prohibited from peddling within the City of Akron.
