§ 111.517. Rates applicable to acceptable discharges to the City sewer system and payment of fees, charges, fines, and rates.

    1.

    The rates shall be based upon:

    a.

    The amount of property devoted to or required to be available to treat acceptable discharges enumerated under § 111.512;

    b.

    Operating, maintaining, and replacement costs consistent with Federal EPA requirements so that the treatment of acceptable discharges referred to herein shall be paid for on a proportionate basis; and

    c.

    All other costs required to provide service plus a return on the capital of the sewer system devoted in whole or in part to provide service herein.

    2.

    The derived rates shall reflect the cost of service subject to continuing Federal EPA requirements and to provide a return on capital and other costs outside EPA requirements.

    3.

    The derived rates shall be recalculated on or before May 1 of 1982, and each year thereafter based on the prior calendar year adjusted to normalize costs and the new calculated rates shall thereafter be effective on July 1 of the particular year.

    4.

    The rates and revised rates shall be determined on a continuing basis under the jurisdiction of the Director of Public Service.

    B.

    1. The rates effective May 1, 1982, through June 30, 1983, and subject to annual revisions thereafter based on May 1 calculations for septic tank cleanings are:

    a. $6.59 per one thousand gallons of acceptable septic tank discharges delivered to the WPCS at the location designated by the Director of Public Services and based on BOD cost per one thousand gallons.
    b. 6.72 per one thousand gallons of acceptable septic tank discharges delivered to the WPCS at the location designated by the Director of Public Services and based on SS cost per one thousand gallons.
    c. 6.09 per one thousand gallons for all other costs related to the cost of service not reflected in the rates for BOD and SS.
    Total For Rate $19.40 Subject to revision each year but to be no less than $19.40 per one thousand gallons.

     

    2.

    The initial rates effective May 1, 1982, through June 30, 1983, and subject to annual revisions thereafter based on May 1 calculations for scavenging cleaning, industrial waste cleaning, and filter cake sludge are:

    a. $29.01 for BOD and SS costs for each one thousand gallons or wet ton of filter cake.
    b.   6.09 for other costs related to cost of service for each one thousand gallons or wet ton of filter cake.
    Total For Initial Rate $35.10 per one thousand gallons or one wet ton of filter cake each year.

     

    3.

    Rates or charges shall he established in addition to the aforementioned rates which shall reflect the additional costs required for acceptable discharges or the handling of filter cake sludge, if acceptable to the city, which items thereby require special handling or special treatment or use of additional facilities of the City sewer system, or any combination thereof, not reflected in the rates under subsections (B)(1)(a), (b), and (c) or (B)(2) (a) and (b) of this section.

    C.

    All persons using the City sewer system shall pay the appropriate fees, charges, fines, and rates in such amounts, at such times, and in such manner as established either under this code or by the Director of Public Service. Penalty, see § 111.999.
