Article 5. Late Night Sales |
§ 110.40. Definitions.
For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
"Interactive audio visual monitoring system." An audio visual monitoring system of a type approved by the Police Department which allows security personnel live access to a retail establishment twenty-four hours a day. Such live access must be capable of being triggered by either an employee or by the remote security monitoring service without detection by a customer. Such monitoring systems must be maintained in proper working order at all times.
"Late night retail establishment." Any person, partnership, corporation, or other entity which:
1.
Derives fifty percent or more of its gross income from the sale of goods, merchandise, or other articles of value, and
2.
Sells goods, merchandise, or other articles of value in their original containers between the hours of 12:00 midnight and 6:00 a.m.
"Late night gasoline station." Any person, partnership, corporation, or other entity who sells gasoline or other petroleum fuel to the public between the hours of 12:00 midnight and 6:00 a.m.
"Pay drawer and/or merchandise drawer." A through-the-wall bullet-resistant security transaction drawer or opening in an exterior wall of a building approved by the Police Department which allow a retail establishment to transact business from the establishment's building without direct customer contact. Such pay and/or merchandise drawer(s) shall be surrounded by bullet-resistant walls and windows as approved by the Police Department. Such pay and/or merchandise drawer(s) must be maintained in proper working order at all times.
"Pay booth." A structure within an establishment or gas station constructed of bullet-resistant windows, walls and doors as approved by the Police Department. Such pay booths and required equipment must be maintained in good working order at all times. Each pay booth must conform to the security requirements set forth in § 110.41(A).
"Video monitoring and recording system." An on-site video security camera of a type or number approved by the Police Department. Such camera(s) must be capable of immediately producing a retrievable image on film or tape that can be made a permanent record and that can be enlarged through projection or other means. Such video monitoring systems must be maintained in proper working order at all times.
