§ 111.140. Definitions.

  • For the purpose of this article the following definitions shall apply unless the context clearly indicates or requires a different meaning.

    "Boarding home for handicapped or feebleminded children," "boarding home for children" or "day nursery." Places of abode, buildings, institutions, residences, or homes used for formal reception, as in a hospital, in which is provided the care, for a consideration, of more than two children who, by reason of immaturity or mental or physical handicap, are not able to take care of themselves properly.

    A "boarding home for handicapped or feeble-minded children" provides board and care for minor children who are in such condition that the parent is unable to take care of them at his home.

    2.

    A "boarding home for children" provides care, food, or lodging for more than five children un-attended by a parent or guardian.

    3.

    A "day nursery" provides care and maintenance for three or more children who are not all members of one family and who are separated from their parents or guardian or persons in loco parentis during a part of the day for more than four consecutive days. The term does not include a public or parochial school.
