§ 113.08. Declarations of packages.

    Except as otherwise provided in this chapter, any commodity in package form shall bear on the outside of the package a definite, plain, and conspicuous declaration of the following:

    1.

    The net quantity of the contents in terms of weight, measure, or count; and

    2.

    In the case of any package not sold on the premises where packed, the name and place of business of the manufacturer, packer, or distributor.

    B.

    However, whenever cheese, meat, fish, poultry, fruits, vegetables, and meat products are packaged under authority of persons in charge of retail stores or retail chain stores, in advance of sale, such products, on being offered for sale, shall bear a label which, in addition to stating the net weight, shall state the price per pound when the total price is stated. It shall not be necessary to state the price per pound whenever the weight of the product is packaged in whole units of the pound, two pounds, three pounds, or nonfractional units of a pound. The qualifying term "when packed" or words of similar import, shall not be used in connection with the declaration required under subsection (A)(1) of this section. Penalty, see § 113.99.
