§ 138.05. Possession of contraband prohibited.

  • A.

    No person shall knowingly or purposely bring, attempt to bring, or otherwise possess any intoxicating liquor, or beer, onto the grounds or within the confines of a detention facility as defined in R.C. § 2921.01(F), without the permission of the facility administrator, superintendent, or warden.

    B.

    No person shall knowingly deliver, or attempt to deliver, cash to any person who is confined in a detention facility.

    C.

    Whoever violates subsection A of this section is guilty of a misdemeanor of the second degree.

    D.

    Whoever violates subsection B of this section is guilty of a misdemeanor of the first degree. If the offender previously has been convicted of or pleaded guilty to a violation of subsection B of this section or a substantially similar state statute, illegal conveyance of cash onto the grounds of a detention facility is a felony punishable under state law.
