§ 138.29. Sale of pharmaceuticals.

A.

No person, retailer or organization shall maintain for sale to the public products containing ephedrine, pseudoephedrine or phenylpropanolamine unless such products are kept in a manner that the purchaser cannot access the product without the assistance of the seller, or an employee or an agent of the selling organization.

B.

The above prohibition does not apply to products which contain more than one active ingredient or that are sold in liquid, liquid capsule, gel capsules or pediatric form.

C.

A violation of subsection A of this section is a minor misdemeanor.
