§ 139.06. Curfew.

  • A.

    No child under the age of eighteen years shall be on the streets or sidewalks of the City between the hours of 11:00 p.m. and 5:00 a.m. of the following day, local time, unless:

    1.

    He is accompanied by his parent, guardian, or an adult person having the legal care, custody, and control of his person;

    2.

    He is accompanied by an adult person having the permission of one of the persons mentioned in subsection (A)(1) of this section; or

    3.

    He is going directly to or from any lawful activity, entertainment, or employment with knowledge and consent of the parent, guardian, or adult person having the legal care, custody and control of his person.

    B.

    No parent, guardian or other person having the care, control, or custody of a minor child under the age of eighteen years shall fail to keep such child off the streets or sidewalks of the city between the hours of 11:00 p.m. and 5:00 a.m. of the following day, local time, unless:

    1.

    Such child is accompanied by such parent, guardian, or other adult person having permission from such parent or guardian to accompany such child; or

    2.

    Such parent or guardian has consented to such child's going to or coming from any lawful activity, entertainment, or employment.

    C.

    No adult person shall be in the company of any child under the age of eighteen years on the streets or sidewalks of the City between the hours of 11:00 p.m. and 5:00 a.m. of the following day, local time, unless such adult person has the permission from the parent or guardian to be in the company of such child during such hours.

    D.

    Whoever violates subsection A or B of this section is guilty of a minor misdemeanor. If the offender has previously been convicted of a violation of subsection A or B of this section, a subsequent violation is a misdemeanor of the fourth degree. Whoever violates subsection C of this section if guilty of a misdemeanor of the fourth degree.
