§ 197.309. Responsibilities of applicants.
A.
Information to Be Provided by Applicant.
1.
The applicant must provide the Superintendent of Building Inspection with a letter prior to final occupancy from a registered surveyor which certifies the actual elevation (in relation to mean sea level) of the lowest habitable floor, including basement, of all new or substantially improved structures, and whether the improved structures contain an enclosure below the lowest floor. Before the required footing inspection is performed, the applicant must provide the Superintendent of Building Inspection with a letter from a registered surveyor which certifies that the footing elevation conforms with this chapter.
2.
For all new or substantially improved floodproofed non-residential structures, the applicant must provide the Superintendent of Building Inspection a letter which:
a.
Verifies and records the actual elevation (in relation to mean sea level) to which the structure was floodproofed.
b.
States the flood-proofing certifications required in § 197.315 of this code are maintained.
B.
Alteration of Watercourses. When construction will alter a watercourse, the applicant shall:
1.
Notify adjacent communities, the U.S. Army Corps of Engineers, and the Ohio Department of Natural Resources, Division of Water, prior to any alteration of the watercourse, and submit evidence of this notification to the Federal Emergency Management Agency. A watercourse is considered to be altered if any change occurs within its banks.
2.
Maintain engineering documentation required in § 197.310 that the flood carrying capacity of the altered or relocated portion of said watercourse will not be diminished.
3.
Require that necessary maintenance will be provided for the altered or relocated portion of said watercourse so that the flood-carrying capacity will not be diminished.
