§ 50.33. Surcharges for extra strength waste—Credits for below-strength waste.
A.
For the purpose of this section, and any other applicable section of Chapter 50, the assigned sewage strength for each user class is as follows:

Sewage or industrial wastes above the assigned sewage strength for each user class but acceptable for discharge into the sanitary sewerage system shall be subject to a surcharge. The surcharge shall be determined on the basis of either or both of two constituents of the water or wastes:
a.
Total suspended solids; and/or
b.
Five-day B.O.D. at twenty degrees Celsius and as herein provided.

When either or both the total suspended solids and the B.O.D. of a water or waste accepted for admission to the system exceeds the values of their assigned strengths, the excess concentration in either or both, as the case may be, shall be subject to a surcharge as follows:
a.
Pounds of excess suspended solids per day x $0.201/lb. = S.S. surcharge per day effective January 1, 2010.
b.
Pounds of excess B.O.D. per day x $0.237/lb. = B.O.D. surcharge per day effective January 1, 2010.

In addition to the surcharge, the user will pay the sewer service and other charges as defined in Sections 50.22 and 50.23 on the entire volume of sewage discharged to the sewerage system.
B.
Sewage or industrial wastes below the assigned sewage strength for master meter suburban users and acceptable for discharge into the sanitary sewerage system shall be subject to a credit. The credit shall be determined on the basis of either or both of two constituents of the water or wastes: total suspended solids; and/or five-day B.O.D. at twenty degrees Celsius as herein provided.

When either or both of the total suspended solids and the B.O.D. of water or waste accepted for admission to the system from a master meter suburban user is less than the values of their assigned strengths, the short fall of concentration in either or both, as the case may be, shall be subject to a credit as follows:
a.
Pounds of short fall of suspended solids x $0.201/lb. = S.S. credit effective January 1, 2010.
b.
Pounds of short fall of B.O.D. x $0.237/lb. = B.O.D. credit effective January 1, 2010.

Master meter users eligible for the above credit will pay the sewer service and other charges as defined in Sections 50.22 and 50.23 on the entire volume of sewage discharged to the sewerage system.
C.
The pounds of B.O.D. and/or pounds of suspended solids above assigned concentrations for each user class that are discharged to the sewerage system, and the pounds B.O.D. and/or pounds of suspended solids below the assigned concentrations for master meter suburban users that are discharged to the sewerage system, shall be determined by the Director, Department of Public Service, on a continuing basis as required.
D.
In addition to a surcharge on B.O.D. and suspended solids, the city shall have the right to surcharge any user for the discharge of any other pollutant into the sewerage system for any other reason that it deems necessary and appropriate and which discharge or pollutant or other reason results in additional costs not covered in the charges under Sections 50.22, 50.23, and this section or other applicable sections in this chapter.
