§ 91.08. Clubs, restaurants, and hotels—Hours of business.

  • A.

    No person, club, night club, restaurant, hotel, or other establishment, except as provided in subsections C and D of this section, shall, directly or indirectly, sell or furnish any intoxicating liquor, wine, beer, or any beverage containing more than 0.5% of alcohol by weight between the hours of 1:00 a.m. and 5:30 a.m.

    B.

    No person, club, night club, restaurant, hotel, or other establishment, except as provided in subsections C and D of this section, shall, directly or indirectly, sell or furnish any intoxicating liquor, wine, or any beverage containing more than 0.5% of alcohol by weight other than beer, on Sunday between the hours of 5:30 a.m. and 12:00 midnight.

    C.

    No person, club, night club, restaurant, hotel, or other establishment holding a D-3-A or D-5 permit shall, directly or indirectly, sell or furnish any intoxicating liquor, wine, beer, or any beverage containing more than 0.5% of alcohol by weight between the hours of 2:30 a.m. and 5:30 a.m. during any day of the week.

    D.

    No person, club, night club, restaurant, hotel, or other establishment holding a D-3-A or D-5 permit shall, directly or indirectly, sell or furnish any intoxicating liquor, wine, or any beverage containing more than 0.5% of alcohol by weight, other than beer, between the hours of 5:30 a.m. Sunday and 5:30 a.m. Monday.

    E.

    Subsections C and D of this section shall apply to those holders of D-3-A or D-5 permits issued by the Ohio Department of Liquor Control, provided that the establishment operated under such permit is located within a district wherein at least fifty-five percent of the foot frontage of property fronting on the same side of the street for a distance of three hundred feet in either direction from the premises so used, exclusive of street intersections, is devoted to uses other than residence uses as defined by the zoning code.
