Article 1. General Provisions |
§ 94.02. Insecticides—Thermal generating devices.
No person shall advertise, offer for sale, display for sale, sell, rent, loan, give away, or use any thermal generator device, apparatus, or appliance which applies heat to sublime, vaporize, discharge, or dispense Lindane, D.D.T., or other toxic material into the atmosphere unless he complies with the following requirements:
A.
The insecticide shall be released at the rate of not to exceed one gram per fifteen thousand cubic feet per twenty-four hours.
B.
Installation shall be made only in commercial or industrial premises, mess halls, and similar locations where human exposure will be on a working day basis and not continuous.
C.
The devices shall not be used in homes or sleeping quarters.
D.
Proper fuses or thermostats and a pilot light to indicate whether the unit is operating shall be built-in features.
E.
Units shall be mounted seven feet above the floor and at least three feet from the ceiling.
F.
The equipment shall not be installed or used in connection with any food processing or food handling establishment, except with the approval of the Director of Health, acting in a manner consistent with the purposes of this chapter. Penalty, see § 94.99.
