§ 98.40. Permit required—Exemptions.

    No person shall make any opening or excavation in or under a street, alley, sidewalk, or other public way or ground without obtaining a permit therefor from the Division of Highway Maintenance and making such deposit of money as may be required by the street opening regulations of the Division. Permits shall be issued only to City divisions and to contractors or corporations covered by adequate public liability insurance.

    B.

    Permits required by subsection (A) of this section shall be issued only on applications made in writing to the Division of Highway Maintenance. Each application shall contain all information required by the Division. A permit shall be issued only after payment of the required permit fee(s) as established by the Director of Public Service. Such fee(s) shall be commensurate with the costs of administering permits, performing inspections and other related services.

    1.

    The state, the county, any department or division of the City or any public utility corporation holding a franchise from the City may obtain necessary street opening permits without prepayment, but shall be charged for necessary street restoration work and inspections.

    2.

    A public utility corporation may be licensed by the Director of Public Service on an annual basis to do its own restoration work in connection with the opening of streets for maintenance and construction work, but shall be charged a sufficient sum to cover inspection costs.

    C.

    1.

    Any person performing work under this section and within any right-of-way shall be required to obtain all necessary permits except that work performed by the City as authorized by the Director of Public Service and administered by the Bureau of Engineering, shall not require permits.

    2.

    Any developer or any person providing subcontract work for any developer under this section and within the right-of-way of a subdivision which has been approved by law and for which the required bond has been posted with the Bureau of Engineering must obtain the necessary permits, but shall not be required to pay for permits obtained during a period of twenty-four months following the approval date of the subdivision plans by the Council of the city.

    All work under this section shall be in accordance with the City Bureau of Engineering construction and material specifications and standard drawings.
