§ 98.72. Permits.

  • No person shall construct a driveway approach or cut, break out, or remove any curb along any street or other public way without obtaining from the Director of Public Service the following permits:

    A.

    A sidewalk permit;

    B.

    A curb cut inspection permit and, if applicable, a drain hole inspection permit when curb cuts and/or drain holes are to be done by persons other than the city. A curb-cut permit is necessary when a new cut is to be made or an old cut redressed or extended; or

    C.

    A street opening permit when new curbing is required to restore an abandoned curb cut; or when existing curbing is required to be cut for driveway approaches or drain holes.

    D.

    An application to the Director of Public Service for a permit shall be submitted in such form as the Director of Public Service may prescribe. Fees and charges for permits shall be established by the Director of Public Service. Such fees and charges shall be commensurate with the costs of administering permits, performing inspections and other related services.

    E.

    1.

    Any person performing work under this section and within any right-of-way shall be required to obtain all necessary permits except that work performed by the City as authorized by the Director of Public Service and administered by the Bureau of Engineering, shall not require permits.

    2.

    Any developer or any person providing subcontract work for any developer under this section and within the right-of-way of a subdivision which has been approved by law and for which the required bond has been posted with the Bureau of Engineering must obtain the necessary permits, but shall not be required to pay for permits obtained during a period of twenty-four months following the approval date of the subdivision plans by the Council of the city.

    All work under this section shall be in accordance with the City Bureau of Engineering construction and material specifications and standard drawings. Penalty, see § 98.99.
