§ 111.564. Requirements for day labor pool temporary employment agencies.

  • A.

    Existing Agencies. All day labor pool temporary employment agencies shall by January 1, 1999:

    1.

    Acquire and maintain liability insurance for the building and any surrounding area owned or leased by the day labor pool temporary employment agency in the minimum amount of one thousand dollars combined single limit for bodily injury, wrongful death or property from any one occurrence;

    2.

    Not allow or permit disorderly conduct, or the possession or consumption of alcoholic beverages in its building or in the surrounding area owned or leased by the day labor pool temporary employment agency;

    3.

    Post permanent signs at the inside of each entrance to the day labor pool temporary employment agency containing:

    a.

    In letters and numbers not less than two inches in height, the days of operation and hours of operation of the temporary employment agency, and

    b.

    In letters not less than three inches in height, the words "No disorderly conduct, or possession or consumption of alcoholic beverages allowed on these premises.";

    4.

    By January 1, 1999, provide a minimum of two trash receptacles of at least thirty gallons in capacity for the day labor pool temporary employment agency's outdoors area if the temporary employment agency owns or leases outdoor areas surrounding the building from which it operates;

    5.

    Maintain daily records of the number of associates served;

    6.

    Install and maintain in proper working order at all times a video surveillance system designed to monitor the day labor pool temporary employment agency from at least two different locations on the day labor pool temporary employment agency site. In conjunction with this video surveillance requirement, a day labor pool temporary employment agency shall post signs at each entrance to its facility stating that the property is under video surveillance;

    7.

    Install and maintain in proper working order at all times mercury vapor and/or high pressure sodium lighting at both the front and rear of the property on which the day labor temporary employment agency is located.

    B.

    Future or Relocated Agencies. In addition to the requirements of subsection A of this section, any day labor pool temporary employment agency established or any current day labor pool temporary employment agency relocated in the City after December 15, 1997 shall:

    1.

    Be located only in areas zoned U3, A4, U3, A5, or U4;

    2.

    Not be located within five hundred feet of a school, public library, public playground, or an establishment with a liquor permit, church or single family residential area;

    3.

    Provide a waiting room area for associates large enough to accommodate a permitted occupancy, as determined by the City Fire Code, equal to twenty-five percent of the average daily number or anticipated number of associates;

    4.

    Provide a number of restroom facilities for associates equal to one for each one hundred of the average number of daily associates;

    5.

    Provide parking in accordance with applicable requirements in Chapter 153; and

    6.

    Be subject to a minimum of two inspections annually by the City Department of Public Service.
