§ 111.050. License.

    No person shall operate a commercial aviary who does not possess an unrevoked license from the Health Commission.

    B.

    Application. The Director of Health shall prescribe the form which he shall issue to those owners or operators of commercial aviaries who have applied in writing for a license, after he has satisfied himself that such commercial aviaries comply with the provisions of this article.

    C.

    Expiration and Renewal. A license shall expire within thirty days following a specific order for noncompliance with any of the rules and regulations promulgated pursuant to § 111.051 but such license may be renewed, after inspection, for compliance with such rules and regulations.

    D.

    Fees.

    1.

    The applicant shall pay an annual license fee of thirty dollars, payable in semiannual installments on January 1 and July 1 of each calendar year and all licenses shall expire at 12:00 midnight on December 31 of each year.

    2.

    For any commercial aviary opened after January 1 but before July 1 in any year, the fee for the remainder of the year shall be thirty dollars, payable fifteen dollars at the date of issuance of the license and fifteen dollars on July 1 succeeding.

    3.

    For any commercial aviary opened after July 1 in any year, the fee for the remainder of the year shall be fifteen dollars, payable upon the issuance of the license.

    E.

    Revocation. A license may be suspended or revoked for serious or repeated violations of any of the rules and regulations promulgated pursuant to § 111.051, provided that the license holder has been notified in writing by the Director of Health, calling attention to specific violations and affording reasonable time and opportunity to comply. When a license is suspended or revoked, the owner or operator of the commercial aviary shall be notified of the conditions for reinstatement. Penalty, see § 111.999.
