§ 93.12. Inspections.
A.
It shall be the duty of the Chief of the Bureau of Fire Prevention to inspect, or cause to be inspected by the Bureau, as often as may be necessary, all buildings and premises, within the corporate limits of the city, for the purpose of ascertaining and causing to be corrected any condition liable to cause fire, or any violation of the provisions or intent of any ordinances of the City affecting fire hazards.
B.
If entry is refused or not obtained, the Chief of the Bureau of Fire Prevention shall issue a notice of inspection and shall conduct the inspection as provided by law.
C.
Each business receiving a notice of inspection under subsection B and each business having regular hours of operation falling outside of normal business hours (0800-1600 Monday through Friday) must contact the Chief of the Bureau of Fire Prevention within seven calendar days of receiving a notice of inspection from the Akron Fire Department. The scheduled inspection must occur within 30 days of the notice of inspection, or as soon as practicable, subject to the provisions of subsection D. Whoever violates this section shall be subject to a penalty of $100.00. A separate offense shall be deemed committed each 30 days a business owner fails to schedule an inspection.
D.
This chapter shall not be construed to require an occupant, operator, or owner to consent to a warrantless inspection of a premises except as provided by law.
